A client retained us in 2018 to file a motion to remove an old final restraining order that was issued against him in 2011 in Warren County. This was an ex-girlfriend who he has had no contact with since then. In addition, he moved in 2012 to North Carolina where he is now married, gainfully employed, and has a one-year-old child to care for. In addition, his wife works at a military base and he has been prohibited from entering the base because of the restraining order.

We filed a motion to remove this restraining order. It must be filed in the county in which it was issued. According to court rule, we must order and attach a transcript of the initial hearing so that this new judge can examine the facts of the original case. We laid out all the facts and circumstances in our brief and all of the reasons that this should now be dismissed as it is no longer necessary to protect the plaintiff. Also according to court rule, we served a copy of our motion papers on the plaintiff so she can object to the restraining order being lifted and appear in court for the hearing if she wants to.

In this case, the opposite happened. After receiving our motion papers and brief, the plaintiff decided that she agreed with us and she voluntarily went to the court and dismissed the restraining order herself. As a result, our motion was moot and no longer had to be ruled on by the judge. The case was dismissed.
