Defending Clients Facing Charges in Newton Municipal Court

Need a Lawyer for Newton Municipal Court

The area of Newton, New Jersey, is patrolled by four squads that consist of three officers and a sergeant that rotate on twelve hour shifts.  The Newton Police Department handles a variety of missing persons, sex crimes, burglaries, drug investigations, noise complaints and domestic disputes.  With that being said, the Newton Municipal Court is responsible for adjudicating cases involving an assortment of criminal offenses. The court also hears traffic tickets and DWI charges issued in the town. While you may initially think that a charge for a disorderly persons or petty disorderly persons offense, a DUI, or a motor vehicle violation bears little to no scrutiny, this is far from the truth. Newton criminal and traffic charges are handled with seriousness and convicted offenders are punished, often harshly.

For a criminal offense heard in the Newton Municipal Court, you could be penalized with up to 6 months of jail time. Even disorderly conduct and harassment, petty disorderly persons offenses, carry up to 30 days in jail. Still more, some criminal offenses entail mandatory sentences like community service for shoplifting charges. Drunk driving and driving under the influence of drugs could also land you in jail, on top of the thousands of dollars in fines, surcharges, and court fees associated with these offenses. License suspensions are also a frequent feature of sentences in New Jersey municipalities, applicable to charges ranging from possession of CDS in a motor vehicle to certain traffic offenses. Whether you have been arrested in Newton or issued a summons and sent on your way, preparing for your upcoming appearance with the help of an experienced defense lawyer in Newton court is crucial. And the time to get started with your top defense approach is now. Our team of seasoned Newton criminal defense lawyers are here to assist you. Newton DWI Attorneys

In New Jersey, an individual with a blood alcohol concentration of 0.08% or greater while operating a boat or a motor vehicle is classified as driving under the influence. Further, the law indicates that an individual may have a DUI by observation, which is usually achieved through an individual’s results on field sobriety tests. Given the number of offenses you have, it is important to have an attorney fighting for you and making sure your experience from to stop to finish was lawful.  The main components of these cases include your DWI prior history, the facts and circumstances involved with your case, and your blood alcohol concentration if it applies.

If this is your first time being charged with a DWI, and your Blood Alcohol Concentration is 0.08% or higher but less than 0.10%, an Interlock device must be installed in your vehicle for a minimum period of three months.  Prior to the installation of this device, your driver’s license is suspended. If your Blood Alcohol Concentration is 0.10% but less than 0.15%, an Interlock device must be installed in your vehicle for a minimum period of seven months to one year.  Again, prior to the installation of this device, your driver’s license is suspended. If your Blood Alcohol Concentration is 0.15% or above, there is driver’s license suspension for a minimum of four to six months.  Again, prior to the installation of this device, you must install Interlock in your vehicle for a minimum period of nine months to fifteen months.  Moreover, the driver’s license is suspended prior to the installation of this device.

If you are a second-time DWI offender, and your Blood Alcohol Concentration is 0.08% or higher, there is driver’s license suspension for a minimum period of one to two years and potential jail time.  Following the suspension period, you must install an ignition interlock in your vehicle for a minimum period of two years to four years. In addition, if it has occurred on more than two instances and you are stopped for a DWI, coupled with your Blood Alcohol Concentration being 0.08% or higher, you will be subjected to a driver’s license suspension, for a minimum period of eight years, and also imprisonment.  Following the suspension period, you must also install the mandatory interlock in your car.

Our attorneys have taken on DWI cases in Newton and throughout New Jersey for years and our aggressive representation comes with the expertise in examining all aspects of your case. We have represented countless clients in a variety of scenarios, whether it is for driving while intoxicated, refusal to submit to a breath test or another driving under the influence offense. Regardless if this is your first DWI or more, you will also be subjected to fees owed to the State and be required to pay for the installation of an interlock device. In addition to other tickets or violations associated with your stop, you may also be subjected to court-mandated alcohol programs or courses and even jail time.  The ramifications that go along with your DWI can be extensive, burdensome and life altering, that is why it is important for highly credentialed and battle-tested DWI defense lawyers at our firm to be called today.

Our lawyers have years of knowledge, practice, and expertise to handle your DWI. Our firm immediately looks at the available discovery for your case. Discovery includes the police report, video/audio footage, BAC test results, and field sobriety test reports. With our skilled defense attorneys certified in the administration of the Alcotest 7110, we ensure each component involved in your stop was lawfully completed. Based on the facts of your case, a skilled attorney at our office can tell if you the stop by police was legal, whether field sobriety tests were accurately performed and if the breathalyzer was properly administered.
