Travis J. Tormey and Christopher Perry of the Tormey Law Firm LLC recently represented a client charged with driving under the influence (DUI) of drugs in Hackettstown, New Jersey. The client was involved in a motor vehicle accident but, luckily, no one was injured. He fell asleep at the wheel and his car drove off the side of the road before coming to a stop without anyone else involved. He was facing a seven (7) month to one (1) year driver’s license suspension if convicted of a first offense driving under the influence of drugs.

Our DUI defense lawyers obtained the discovery evidence (police reports, videos, etc.) as well as the report of the state’s drug recognition expert (known as a “DRE”). This is a police officer who is specially trained to perform testing to determine if someone is under the influence of drugs. In addition, our client provided a urine sample which was tested by the lab. The DRE claimed that our client was under the influence of prescription drugs and marijuana and that he observed “green coloring” in his mouth consistent with marijuana consumption. However, the client’s urine sample showed no marijuana use whatsoever and only prescription drugs (which he was prescribed by a doctor). Based on these inconsistencies, we obtained our own DRE expert, a retired police officer who used to perform DRE analysis for the State of NJ. He contested the opinions and conclusions of the State’s DRE expert.

Based on these evidentiary issues, the prosecutor in Hackettstown agreed to dismiss the drug aspects of the case and perform on an “observations” only prosecution. As a result, our client received only a three (3) month driver’s license loss instead of the seven (7) months to (1) year he would have received if he was convicted of the drug DUI.
